Chula Vista, California becomes model for blight control laws in the US

Tuesday, October 14, 2008

The San Diego, California suburb of Chula Vista has responded to the recent housing crisis with an aggressive blight control ordinance that compels lenders to maintain the appearance of vacant homes. As foreclosures increase both locally and throughout the United States, the one year old ordinance has become a model for other cities overwhelmed by the problem of abandoned homes that decay into neighborhood eyesores.

Chula Vista city code enforcement manager Doug Leeper told the San Diego Union Tribune that over 300 jurisdictions have contacted his office during the past year with inquiries about the city’s tough local ordinance. Coral Springs, Florida, and California towns Stockton, Santee, Riverside County, and Murietta have all modeled recently enacted anti-blight measures after Chula Vista’s. On Wednesday, 8 October, the Escondido City Council also voted to tighten local measures making lenders more accountable for maintenance of empty homes.

Lenders will respond when it costs them less to maintain the property than to ignore local agency requirements.

Under the Chula Vista ordinance lenders become legally responsible for upkeep as soon as a notice of mortgage default gets filed on a vacant dwelling, before actual ownership of the dwelling returns to the lender. Leeper regards that as “the cutting-edge part of our ordinance”. Chula Vista also requires prompt registration of vacant homes and applies stiff fines as high as US$1000 per day for failure to maintain a property. Since foreclosed properties are subject to frequent resale between mortgage brokers, city officials enforce the fines by sending notices to every name on title documents and placing a lien on the property, which prevents further resale until outstanding fines have been paid. In the year since the ordinance went into effect the city has applied $850,000 in fines and penalties, of which it has collected $200,000 to date. The city has collected an additional $77,000 in registration fees on vacant homes.

Jolie Houston, an attorney in San Jose, believes “Lenders will respond when it costs them less to maintain the property than to ignore local agency requirements.” Traditionally, local governments have resorted to addressing blight problems on abandoned properties with public funds, mowing overgrown lawns and performing other vital functions, then seeking repayment afterward. Chula Vista has moved that responsibility to an upfront obligation upon lenders.

That kind of measure will add additional costs to banks that have been hit really hard already and ultimately the cost will be transferred down to consumers and investors.

As one of the fastest growing cities in the United States during recent years, Chula Vista saw 22.6% growth between 2000 and 2006, which brought the city’s population from 173,556 in the 2000 census to an estimated 212,756, according to the U.S. Census Bureau. Chula Vista placed among the nation’s 20 fastest growing cities in 2004. A large proportion of local homes were purchased during the recent housing boom using creative financing options that purchasers did not understand were beyond their means. Average home prices in San Diego County declined by 25% in the last year, which is the steepest drop on record. Many homeowners in the region currently owe more than their homes are worth and confront rising balloon payment mortgages that they had expected to afford by refinancing new equity that either vanished or never materialized. In August 2008, Chula Vista’s eastern 91913 zip code had the highest home mortgage default rate in the county with 154 filings and 94 foreclosures, an increase of 154% over one year previously. Regionally, the county saw 1,979 foreclosures in August.

Professionals from the real estate and mortgage industries object to Chula Vista’s response to the crisis for the additional burdens it places on their struggling finances. Said San Diego real estate agent Marc Carpenter, “that kind of measure will add additional costs to banks that have been hit really hard already and ultimately the cost will be transferred down to consumers and investors.” Yet city councils in many communities have been under pressure to do something about increasing numbers of vacant properties. Concentrations of abandoned and neglected homes can attract vandals who hasten the decline of struggling neighborhoods. Jolie Houston explained that city officials “can’t fix the lending problem, but they can try to prevent neighborhoods from becoming blighted.”

CEO Robert Klein of Safeguard, a property management firm, told the Union Tribune that his industry is having difficulty adapting to the rapidly changing local ordinances. “Every day we discover a new ordinance coming out of somewhere”, he complained. Dustin Hobbs, a spokesman from the California Association of Mortgage Bankers agreed that uneven local ordinances are likely to increase the costs of lending. Hobbs advised that local legislation is unnecessary due to California State Senate Bill 1137, which was recently approved to address blight. Yet according to Houston, the statewide measure falls short because it fails to address upkeep needs during the months between the time when foreclosure begins and when the lender takes title.

Wikinews interviews former Salt Lake City mayor and 2012 presidential candidate Rocky Anderson

Wednesday, December 21, 2011

Former Salt Lake City mayor and human rights activist Rocky Anderson took some time to discuss his 2012 U.S. presidential campaign and the newly-created Justice Party with Wikinews reporter William S. Saturn.

Anderson served as mayor of Salt Lake City for eight years (2000–2008) as a member of the Democratic Party. During his tenure, he enacted proposals to reduce the city’s carbon emissions, reformed its criminal justice system, and positioned it as a leading sanctuary for refugees. After leaving office, Anderson grew critical of the Democratic Party’s failure to push for impeachment against President George W. Bush, and for not reversing policies on torture, taxes, and defense spending. He left the party earlier this year and announced that he would form a Third party.

Anderson officially established the Justice Party last week during a press conference in Washington D.C.. He proclaimed “We the people are powerful enough to end the perverse government-to-the-highest-bidder system sustained by the two dominant parties…We are here today for the sake of justice — social justice, environmental justice and economic justice.” The party promotes campaign finance reform and is attempting to appeal to the Occupy Wall Street movement. It is currently working on ballot access efforts, and will hold a Founding Convention in February 2012 in Salt Lake City.

Among other issues, Anderson discussed climate change, health care, education, and civil liberties. He detailed his successes as mayor of Salt Lake City, stressed the importance of executive experience, and expressed his views on President Barack Obama and some of the Republican Party presidential candidates. He spoke in depth about former Massachusetts governor Mitt Romney, with whom he worked during the 2002 Winter Olympics, and fellow Utahan, former governor and U.S. ambassador to China Jon Huntsman, Jr..

Condominiums and apartments at former mental hospital burn to the ground

Saturday, April 7, 2007

The former State Lunatic Hospital at Danvers better known as Danvers State Hospital in Danvers, Massachusetts suffered a major fire last night that could be seen for miles and led to temporary shut down of US Route 1 and Interstate 95 in the area.

The infamous American former mental hospital has been closed since 1992 is the site of a new condominium and apartment buliding complex being developed by Avalon Bay Communities. Four apartment units and four utilities bulidings went in up in smoke in the four-alarm fire. The units were not occupied, however, two were nearing completion which is a major financial setback for Avalon Bay. The fire did not spread to the famous Kirkbride building though, which is being renovated into apartments, aside from a cupola due to radiant heat.

Calls started coming just before 2:00 am EDT Saturday morning to report a fire on the hospital’s grounds which before the development sat unused, decaying and abandoned and became a popular target for ghost-hunters, vandals and urban explorers and also served as the focus of the 2001 thriller/horror film, Session 9 which brought renewed attention to infamous hospital which led to increased security at the site over the years. Reports of explosions before the fire started were noted by neighbors and residents.

About 20 residents on the other side of the 77-acre property were evacuated to Danvers High School as a precaution, they are expected to return later today. Their homes were not harmed by the fire, nor were any injuries reported from them. However, about seven firefighters suffered some minor burns from battling the fire, which took seven hours to bring under control. Firefighters will remain on the scene to make sure no hot spots flare up as the fire is still smoldering.

The cause of the fire is not yet known.

Oil in Alberta spill may be carcinogenic

Wednesday, August 10, 2005

The province of Alberta, Canada is considering legal action against Canadian National Railway for failing to warn that a derailment last week contaminated Wabamun Lake with a hazardous chemical.

The 700,000 litres of heavy Bunker C fuel oil that spilled into the lake asphyxiated birds and killed fish.

In addition, one of the ruptured tanker cars sent 70,000 liters of Imperial Pole Treating Oil into the lake. This oil is a yellow mixture of polycyclic aromatic hydrocarbons and aliphatic hydrocarbons. Naphthalene, a component of this “very toxic material” is suspected of causing skin cancer if touched and lung or other cancers if inhaled.[1] Inhalation is promoted by actions that cause splashing or foaming. The mineral oil is used in connection with pentachlorophenol for preserving wooden utility poles.

Wabamun Lake is a popular summertime recreational area about 65 kilometers (40 miles) west of Edmonton, Alberta.

The 766-megawatt Keephills power generating plant, one of 3 in Wabamun, was shut down because the coal-fired plant uses water from the lake. Edmonton’s health authority ordered people not to swim, boat or rescue animals in the lake and to stop using its water or any water from nearby wells for cooking, drinking, showering or brushing teeth. These warnings came 3 days after many residents, including children, had been wading into the oil slick without protective clothing to save wildlife injured by the spill and others had been routinely depending on the lakewater for home use. Why the alert was not issued sooner remains under investigation and may result in criminal charges. Canadian National Railway had been informed of the nature of the oil when it was loaded by Imperial Oil Ltd., Canada’s largest petroleum company. Imperial Oil is posting informational updates on a special website [2]. In addition The Wabamun Residents Committee has established an information website [3].

Funding Adult Education Courses In The Recession

Funding adult education courses in the recession

by

Carla Jack

Continuing education programmes for adults actually increase during times of recession. There is a greater level of competition for fewer jobs and a focus on increasing your value to existing and potential employers.

Rising competition, emerging technologies and awareness of personal development all lead to an increased need to equip themselves with a new set of skills. Preparation is key when facing the prospect of a career change.

While many people understand the value of continued education, most overestimate the costs involved. Many adult education courses do not require you to leave work and study full time. There are many flexible, part-time or online courses available. There is also a wide range of funding and subsidization options. You can strengthen career prospects without destabilising your finances. Continuing education provides a return on investment and an opportunity to position yourself for when the economy recovers.

Funding Adult education courses:

Many employers recognize the value of continued education and will either fund adult education courses or offer onsite training. Employers are increasingly realising the benefits to their businesses. Check with your employer’s human resources department to find out about the options available. You may need to consider what kind of education your employer is willing to pay for, as well as any grade requirements.

You could qualify for free adult education courses if you are unemployed or have recently been made redundant. There are government initiatives aimed at improving the skills, qualification levels and ability of those seeking work. In Ireland Labour Market Activation (LMA) is a government run programme that will cover course fees for those that qualify. You would be able to carry on claiming your job seekers allowance and benefit payments while attending adult education courses.

There may also be low cost or free adult education courses in your community. These courses usually focus on specific skills.

Many educational institutions offer scholarships, grants and tuition assistance programmes. Many are specifically aimed at those without work, or seeking adult education courses to improve their circumstances. It is worth finding out about the requirements of such assistance, as bursaries and grants differ depending on your circumstances and where you study. Banks offer interest free or cut rate loans to students seeking vocational training while at work. These loans will need to be paid back over an agreed period of time.

Distance Learning and Online Courses

Online learning has changed the face of adult education courses. The quality of online courses is improving, and many free or discounted courses can be found online. Online courses can be extremely flexible and cost effective and in some cases interaction with lecturers and other students is web-based.

Invest in adult education courses to upskill in a competitive job market and increase your career prospects. There are high levels of flexibility and so many options to subsidise and fund continuing education. There has never been a better time to discover the course that will give you a competitive advantage in your career, or unlock new opportunities for growth.

United States: Two killed, more than a hundred injured in Amtrak train collision in South Carolina

Wednesday, February 7, 2018

Early on Sunday morning, Amtrak’s passenger train number 91, the Silver Star, bound for Miami from New York, slammed into a stationary CSX freight train in Cayce, about ten miles (16 km) south of Columbia, capital of the US state of South Carolina. Two Amtrak employees were killed and at least 116 were injured, some seriously.

The two killed were 54-year-old engineer Michael Kempf of Savannah, Georgia, and 36-year-old conductor Michael Cella of Orange Park, Florida. Robert Sumwalt, chairman of the National Transportation Safety Board, told a press conference the passenger train had been diverted into a siding by a switch left “literally locked, with a padlock” in that position.

The collision happened at about 2:35 am local time (0735 UTC) at a switching yard in the small city of Cayce. The Amtrak train, with reportedly 139 passengers and eight employees aboard, collided head on with the freight train, which was parked with no one on board. The Amtrak locomotive and the leading locomotive on the freight train were destroyed; the Amtrak locomotive and some of its passenger cars derailed, and one of those cars was folded in half. Several freight cars were crumpled, Reuters reported. In a press conference, the state governor, Henry McMaster, said the Amtrak locomotive was “barely recognizable” and described it as “a horrible thing to see, to understand the force involved”.

Harrison Cahill, a spokesman for Lexington County, gave a count of 116 injured, up from an initial report of 70; according to Derrec Becker, public information officer for the South Carolina Emergency Management Division, injuries ranged “from cuts and bruises to severe broken bones”. On Monday a Palmetto Health spokesperson said two patients were in serious and two in critical condition at their facilities. A spill of approximately 5,000 gallons of fuel from the freight train posed no safety hazard, according to officials.

Passenger Derek Pettaway told the CNN network that like most others, he had been sleeping when the collision happened. He said Amtrak staff cleared the passengers from the train rapidly, and there was no panic; “I think people were more in shock than anything else”, he said.

“Key to this investigation is learning why the switch was lined that way”, Sumwalt said. Amtrak’s CEO, Richard Anderson, speaking to reporters on Sunday, held CSX responsible; he stated the track in that area is operated by CSX and the signals, which CSX operates, were not working at the time of the collision and a CSX dispatcher was therefore directing the Amtrak train’s movements. Sumwalt noted an automatic monitoring and braking system called positive train control, which was not in use on the stretch of line, could have forestalled the collision.

Several fatal incidents involving Amtrak trains have occurred in the past three months. On December 18, the inaugural train on a new route in Washington state derailed at high speed while crossing above a highway, killing three; on January 31, the driver of a garbage truck was killed in Virginia when he collided with an Amtrak train chartered to take Republican lawmakers to a retreat.

NASA unveils detailed map of Antarctica

Wednesday, November 28, 2007

Scientists at NASA have recently released the most detailed map of Antarctica ever. NASA’s Landsat 7 satellite took 10,000 photographs of the continent over a period of two years, from 1999 to 2001. 1,100 pictures were chosen to form the mosaic map. Officially titled the Landsat Image Mosaic of Antarctica (LIMA), the map reveals Antarctica’s geography in high definition and with accurate colors. Details as small as half the size of a basketball court are visible.

NASA created the map to coincide with the International Polar Year of 2007-2008. Robert Bindschadler, chief scientist of the Hydrospheric and Biospheric Sciences Laboratory at NASA’s Goddard Space Flight Center, remarked, “This innovation is like watching high-definition TV in living color versus watching the picture on a grainy black-and-white television.” The map represents a tenfold improvement over previous Antarctic imagery databases.

This innovation is like watching high-definition TV in living color versus watching the picture on a grainy black-and-white television.

Landsat 7 managed to capture 80% of the continent in high definition. While the satellite was not able to take photographs of the South Pole due to its orbit path, lower-resolution images helped fill in the gap.

The map will help scientists plan and carry out expeditions on the notoriously difficult terrain. The new, intensely detailed information will also facilitate the tracking of environmental changes such as the calving of ice shelves. Researchers will be able to use such data to better understand phenomena like global warming in such amazing detail that even relatively small changes will be visible. Geologists, on the other hand, will be able to use the maps to study Antarctic rock formations.

The LIMA images are available to the public via the internet. The National Science Foundation contributed nearly US$1 million to create the website.

The Landsat 7 satellite will continue to document Antarctica from space through to 2011. Subsequently, NASA will launch the Landsat Data Continuity Mission. Information from both projects will update the map.

Federally-funded abstinence programs fraught with problems: Report

Thursday, December 2, 2004

WASHINGTON, DC — According to a report issued by U.S. House of Representatives Congressman Henry A. Waxman (DCA), the majority of abstinence-only sexual education programs in schools contain incorrect or misleading information.

The report found that over 80% of the curricula used by the recipients of the grants contained incorrect information, including the claim that condoms did not prevent the spread of STDs and that abortions have a high chance of causing sterility.[1]

These programs are funded by the federal government under President George W. Bush’s faith-based initiative. According to the report, these abstinence programs—promoted by the administration of President Bush—are receiving increasing amounts of funding: nearly $170 million will be spent in 2005, which is more than double the spending on these programs in 2001.[2]

Under the faith-based initiative programs, the United States government allocates funds to religious and other community organizations that agree to carry out abstinence education programs which do not include coverage of any other methods of birth control or sexually transmitted disease prevention, as well as other criteria.

The timing of the report is significant in that it comes on the heels of research from Columbia University that found that nearly 9 of 10 teenagers who had pledged abstinence from pre-marital sex had broken their vows in the first six years since the pledges[3].

The Waxman Report and the Columbia University study describe some abstinence programs as factually wrong and/or ineffective. In a rebuttal, Dr. Alma L. Golden, a deputy assistant secretary in the Health and Human Services Department, said in a statement that Mr. Waxman’s report “misses the boat” and that it took information out of context “for purely political reasons.”[4]
