11-year-old California girl charged for throwing stone in defense

An 11-year-old girl faces serious assault charges in California after casting a stone at a group of boys who were throwing water balloons at her. In April, Maribel Cuevas was apprehended by Fresno, California police and spent five days in a detention center after throwing the object at the group of boys who bombarded her with water balloons as she walked down the sidewalk. A 9-year-old boy was hit with the stone, and suffered a wound to his head requiring medical assistance.

Since then, Cuevas has spent one month under house arrest pending court. Cuevas’ lawyer, Richard Beshwate, told the BBC that “They [Fresno police] are treating her like a violent parole offender. It’s not a felony, it’s an 11-year-old acting like an 11-year-old.”

Fresno Police Sergeant Anthony Martinez told reporters: “We responded. We determined a felony assault had taken place and the officers took the actions that were necessary.” Cuevas is due back in court next month on felony assault charges.

The girl was placed in juvenile hall during her five-day detention, with only one 30-minute visit from her parents. She was then placed under a 30 day house arrest and required to wear an electronic monitoring bracelet. The house arrest allowed the girl to attend school.

Maribel, who knows very little English, said that the boy initiated the conflict — the boy also admitted as much.

TDSP stands for Transmission/Distribution Service Provider. That probably doesn’t mean all that much to the average Texan, although I’d wager it’s only the term that is unfamiliar, and not actually the companies themselves. But first, let’s take a quick look at what a TDSP is exactly, and what their role is in energy service after Texas became deregulated.

History of the TDSP in Texas Electricity

When the state of Texas deregulated, it forced the incumbent companies (like Reliant, TXU, etc) to break up into different pieces. Before the electric companies provided full scale electricity service, which included maintenance of the electricity infrastructure and getting electricity from the plants to the customers, from start to finish (with a few exceptions). When the state of Texas deregulated, that practice made way for individual Retail Electricity Providers (REPs). At this point, it became a conflict of interest for the already existing former Incumbents to retain ownership of their own Transmission and Distribution systems, as it would create an obvious competitive advantage for the bigger and already established companies.

At the same time, it was also illogical and unreasonable to expect smaller and newly created REP’s to have to build and create their own infrastructure for delivering electricity to their customers. One, it would create excessive redundancy that would be expensive and serve no purpose, and two, the amount of money it would take to construct an infrastructure from scratch would act as immediate barriers of entry for new companies, defeating the entire purpose of deregulation in the first place.

The Difference between a TDSP and the REP

The TDSP, as already mentioned, maintain the infrastructure for electricity transmission or distribution. The names you probably recognize include Centerpoint (split from Reliant), Oncor (Splint from TXU) Texas New Mexico Power Company, AEP North, and AEP Central. These are the TDSPs who own the power lines and come out to repair them when they go down. They’re also responsible for transmitting the electricity over those lines from the power generators and into a customer’s home. The electricity they own they sell to the REPs wholesale, and they also charge the REP’s monthly charges for the upkeep of the infrastructure.

So that is a quick overview of how the TDSPs work in the state of Texas. To use a metaphor that helps make the understanding easier, the TDSPs are like the guys who ship in all the popcorn, hot dogs, sodas and pretzels to the ballparks, which customers then walk up to counters and purchase at the concession stands. They essentially ‘stock the shelves’ for the customers.

US continues to deny Red Cross access to all detainees

In a statement released on Thursday, the International Committee of the Red Cross (ICRC) said that ICRC President Jacob Kellenberger “deplored the fact that the U.S. authorities had not moved closer to granting the ICRC access to persons held in undisclosed locations.”

The ICRC started making requests to get access to all U.S. detainees, including the ones held in alleged secret prisons, over two years ago. After Kellenberger met with senior officials, including Secretary of State Condoleezza Rice, Defense Secretary Donald Rumsfeld, and National Security Adviser Stephen Hadley, he was again refused access to terrorist suspects held in secret detention centers, chief ICRC spokesperson Antonella Notari said on Friday.

Kellenberger said that “No matter how legitimate the grounds for detention, there exists no right to conceal a person’s whereabouts or to deny that he or she is being detained”.

In response, U.S. State Department spokesman Sean McCormack said that the ICRC has access to the vast majority of U.S. detainees, but said that “There is a certain subcategory of individuals who have forfeited their protections under the Geneva Conventions and there is not an obligation to allow access to those individuals.”

Minetest is an open-source game, which is free for anyone to download and play. It is written in the C++ programming language, and the source code is available on code-hosting site GitHub. According to Ahola, Minetest attempts to run on older hardware, with limited graphics, but to be accessible to more people: those who have outdated technology, and making it available for no cost. Minecraft, on the other hand, is a paid game, currently costing USD 26.95 for its computer version. Minecraft is currently owned by Microsoft, and performs poorly on older hardware.

Candidates walk out of Afghan election audit

Afghanistan’s two presidential candidates, Ashraf Ghani and Abdullah Abdullah, withdrew their observers from the ongoing audit of votes yesterday, following the June presidential election.

Abdullah’s observers declined to participate, claiming fraudulent ballots were not being thrown out and questioning the legitimacy of the process. Ghani’s observers were later asked to withdraw by the United Nations monitors overseeing the process. They agreed, describing the decision as prudent.

The audit was continued in the afternoon.

The process of checking each of the eight million votes is part of a deal brokered by the US. The recount started a month ago. A spokesman for President Hamid Karzai has said the delay is affecting the country’s security, as the Taliban continue to launch attacks across the country. Analysts suggest it is also affecting the Afghan economy.

Both candidates have previously agreed to form a unity government involving the other. Abdullah’s side, trailing before the recount, is looking for more powers and responsibilities for the losing side, while their opposition apparently don’t want to weaken presidential power. Both candidates also agree US forces should stay in the country after 2014.
