Kent Hovind’s April 2007 appeal denied

Kent Hovind‘s motion for acquittal was denied on Wednesday, April 18, 2007. Hovind, a Pensacola young Earth creationist and operator of Dinosaur Adventure Land, along with his wife, Jo Hovind, were found guilty in November 2006 on 58 federal counts of “willful failure” to payroll taxes, structuring bank withdrawals, and obstructing federal agents.

On January 19, 2007 Kent was sentenced to ten years in prison and ordered to pay US$640,000 in owed funds to the Internal Revenue Service, pay prosecution’s court costs of $7,078, and serve three years parole once released.

In his motion, Hovind had contended that under the rule in a case called United States v. Davenport the crime is not the individual withdrawals, but is instead the total transaction, also known as the “unit of the crime.” Thus, Hovind argued that in his case there was no “unit of the crime” “separate and distinct from the alleged act of withdrawing, and without such a separate amount to be structured [. . .] there could be no crime alleged, and no conviction on any charge in Counts 13 through 57.” The trial court rejected Hovind’s “unit of the crime” argument.

Had the judge ruled in Hovind’s favor his sentence would have reduced Hovind’s prison sentence from ten years to five years.

Jo Hovind sentencing was delayed pending the ruling on the motion. She will be sentenced soon though no date has been set.

Two Kentucky Fried Chicken restaurants close in Buffalo, New York, USA

At least two Kentucky Fried Chicken [KFC] restaurants, operated by G & H Restaurant Specialties, have closed in Buffalo, New York “for remodeling,” according to signs placed on the front doors of at least one location on Elmwood Avenue and Bryant Street in Buffalo. The other KFC is located on East Delavan Avenue, also in the City of Buffalo.

Despite the claim of closing for remodeling, the Erie County Health Department says that several health code violations were found at both locations. The most recent violation was logged by the health department in March at the Elmwood location for failing to keep food stored at correct temperatures. Violations were also cited for failing to keep cooking supplies and equipment sanitary and for not supplying hot water to the bathroom for employees.

G & H Restaurant Specialties has not released a statement regarding the violations, but the corporate offices in Louisville, Kentucky for KFC said, “our franchisee has finalized a plan for some structural repairs… The units will be temporarily closed while these building maintenance issues are addressed. [They will be] re-opened as soon as the repairs are complete.”

The health department also gave violations out to the East Delevan store for failing to maintain a clean floor throughout the restaurant and for not stopping food from becoming contaminated. Several rat traps were also found inside the storage cooler and around the kitchen area, but the establishment was “not free of rodents,” said Commissioner of the Erie County Health Department, Dr. Anthony Billittier.

Billittier also said that caulking and traps were seen on the outside of the East Delevan restaurant, which was an attempt to keep the rats out. “It shows that they’re trying to take care of a problem. But it also shows that they have a problem.”

As of Thursday, May 10, 2007, the Elmwood KFC has yet to reopen. It is not known if the East Delevan location opened today or not.

Australian House of Representatives grows heated over industrial relations legislation

Australian industral relations reform legislationmade up of 700 pages of bill legislation and 500 additional pages of explanatory memoranda was introduced into the Federal House of Representatives November 2, where the Opposition heatedly attempted to address their perceived problem of the Government’s lack of discussion and debate over the matter.

The first reading of the bill was the first order of the day, and when Kevin Andrews tried to do so, Opposition member Stephen Smith, responsible for workplace relations, immediately moved a motion deferring the bills to the House of Representatives Standing Committee on Employment, Workplace Relations and Workforce Participation. The Leader of the House, Tony Abbott moved that Smith and the necessary supporter — viz., Julia Gillard — be not further heard (cloture). The Government’s majority in the House ensured that this would happen. However, Opposition members attempted to use House standing orders necessitating that copies of the bill to be “available to Members”, with argument arising whether “available to Members” meant all members or simply whether some copies should be available; this ended up in a dissent motion moved against the Speaker of the House.

Later, in a heated Question Time, where six members of the Opposition, (Kelly Hoare, Julia Irwin, Anthony Albanese, Bernard Ripoll, Catherine King, and Gavan O’Connor), were removed from the Chamber during Question Time under standing orders for disruption — Jill Hall quipped that she was “glad to be still here to ask [her] question” — nearly all questions to the Government put by the Opposition, the subsequent time for matters of public importance, and some members in the adjournment debate, was all on the topic of the industrial relations reform.

To implement and fund the legislation, the government will “spend an additional $486million on industrial relations changes over four years, or $121million a year. This spending would be in addition to the present annual budget of $86million.” said an unnamed government source for The Australian.

The government will need to use its corporation powers to remove the powers from the states to alter the award conditions and other employee employer related conditions. But the New South Wales premier Morris Iemma has received legal advice that the legislation maybe unconstitutional, the reason being its being used to end the role of the states and territories Australian States in the industrial relations system. “It is our view that the Commonwealth is misusing this law to achieve exactly what it was designed to prevent”, Iemma said. Mr Iemma will be challenging the changes in the high court with Peter Beattie Premier of Queensland supporting his challenge in the High Court.

Morogoro Plastic, funded by Barclays, to open $2m network of recycling plants in Tanzania

Morogoro Plastic will open a plastic grinding plant in the Tanzania town of Morogoro in April of 2005, according to Faustine Rwambali of the East African. The grinding plant will be followed by a network of 5 washing plants around Tanzania. 75% of the $2m (2bn Tsh) investment needed to build the system of plants has been provided by Barclays. The first three washing plants will be in Mwanza, Arusha, and Dar es Salaam, followed by a plant on the island of Zanzibar and one in the southern part of the country.

The East African, a weekly business paper published by the Aga Khan’s Nation Media Group, reports the grinding plant will have a daily capacity of 3 tons of plastic. This capacity will be upgraded to 10 tons per day once equipment ordered from Portugal arrives in June, reported IPPMedia, the news arm of East African beverage conglomerate IPP Holdings. Praful Ladwa, the director of Morogoro Plastic, claims Tanzania produces 1000 tons of plastic per day. Once the full network of plants is functioning, Ladwa hopes it will be able to handle more than 75% of that waste stream.

According to the East African, Tanzania has 15 to 20 plastics companies. Ladwa said the new plant system will be the “first of its kind in East and Central Africa.” Morogoro Plastic plans to expand its recycling operations into neighboring Kenya and Uganda by 2007. Ladwa asserted that the system would create at least 10,000 jobs in the region.

Drug-resistant staph deaths surpass AIDS in the United States

Methicillin-resistant staphylococcus aureus (MRSA), a drug-resistant strain of bacteria, killed nearly 19,000 Americans in 2005 alone, according to a new study in the Journal of the American Medical Association. That is more people than were killed by AIDS in the United States. More than 94,000 Americans were afflicted with MRSA infections in 2005.

Although the supergerm, or superbug, is primarily found in hospitals, a growing number of cases have been contracted at public gyms and schools. In Moneta, Virginia, a high school senior died from an infection that spread to his kidney, liver, lungs and heart. In Bedford County, where Moneta is located, school officials have reported five cases of the Methicillin-resistant strain of the Staph bacteria. County officials closed the schools to clean them.

“Certainly, MRSA now has to be viewed as a very important target for prevention and control,” said Dr. David A. Talan, an infectious diseases specialist at Olive View-UCLA Medical Center.

Napier is known as the Art Deco capital of the world as many of the citys buildings were rebuilt in the 1930s due to a devastating earthquake in 1931. Napiers history begins with the Maoris who first inhabited the area many centuries ago. It was this group of Maoris who were the first to come in contact with European settlers in 1769 when Captain James Cook sailed by what is known as Hawkes Bay. Believing that the Maoris were hostile, Cook decided not to land but took note of the area naming it after Sir Edward Hawke, First Lord of the Admiralty. It wasnt until much later in the early 1830s that European settlers began to move into the area including traders, whalers and missionaries and by the 1850s farmers and hotel owners had arrived.

The town grew in size over the years and was officially named a borough in 1874. On February 3, 1931 the town of Napier was razed to the ground by a powerful earthquake that flattened most of the town centre with the ensuing fires killing over 250 people. The massive rebuild that occurred in the following decade makes Napier the town it is today and one of two of the best preserved Art Deco towns in the world along with an area of Miami Beach, Florida. There are over 4000 hectares of land now visible in Napier that were underwater before the earthquake struck and pushed the land out of the sea.

Although some of the Art Deco buildings were replaced with more modern structures in the 1960s, 1970s and 1980s, the historic and aesthetic value was fortunately realised in the 1990s and the centre of town became protected and restored. In 2007, Napier became the first cultural site in New Zealand to be nominated with UNESCO as a world heritage site.

Napier now attracts 1000s of architecture enthusiasts annually from all over the world and even those without an interest in architecture enjoy Napiers unique city centre with its bright colours and ornate finishes. Napier also boasts the Hawkes Bay Museum and Art Gallery, National Aquarium, the Soundshell (outdoor stage and forecourt) and the iconic Pania of the Reef statue (often compared to Copenhagens Little Mermaid) , based on Maori legend about a beautiful mermaid who lived in the surrounding sea.
